Responsibilities
  • Effectively executes civil enforcement strategies that are tailored to address specific problems of fraud and abuse. Displays vigilance and sensitivity to abuse of the bankruptcy system. Devises appropriate strategies for seeking remedies under 11 U.S.C. §§ 110, 329, 707(a) and (b), 727, as well as provisions relating to debtor audits, creditor abuse, and other bankruptcy statutes.
  • Under the direction of the government official independently investigate civil enforcement matters. When unusual or controversial issues arise, timely consults with the USTP and recommends appropriate solutions. Recommendations are useful and reflect an understanding of the probable consequences of the action or recommendation.
  • Works with bankruptcy analysts and other staff on a regular basis to monitor debtor compliance with U. S. Trustee Program reporting. Appropriately reviews and comments on plans, disclosure statements, and other submissions by debtor
  • Demonstrates a thorough understanding of bankruptcy statutes, rules, and case law. Ensures time limits are consistently met and work products reflect professionalism in both draftsmanship and substance.
  • Keeps USTP regularly and fully apprised of major issues and concerns, particularly departures from fiduciary standards and noncompliance with law and Program policies. Makes sound recommendations regarding enforcement or other remedial actions.
  • Adheres to professional and ethical standards prescribed by Department regulations and Program procedures and requirements.
  • Notifies the USTP when it appears there may be difficulty in meeting an internal or external deadline. Requests for extensions of time are well justified.
  • Interacts with the USTP Staff, contractors, and others in a courteous and constructive manner, demonstrating sensitivity to the needs of others and the ability to work cooperatively.
  • Responds positively to constructive comments from the USTP, incorporating, as appropriate, the comments and advice in work product. Regularly meets record, timekeeping, and reporting requirements.
  • Demonstrates quality, thoroughness, and accountability in work activities.


Requirements

The Subject Matter Expert Bankruptcy Auditor / Financial Analyst shall have the following minimum qualifications:
  • Minimum Experience: Three (3) years legal experience including significant experience and demonstrated ability in all aspects of litigation including motion practice, discovery, and trial practice before the bankruptcy court. 
  • Minimum Education: Juris Doctor (J.D.) degree
The SME shall be responsible reviewing civil enforcement actions in bankruptcy cases, Chapter 11 cases, as well as other duties and special projects as may be assigned. Assignments are analytical and investigative in nature and require a professional knowledge of bankruptcy law and practice, including difficult and complex chapter 7 and chapter 11 bankruptcy cases.
  • Experience in pre-trial discovery and the ability to evaluate and develop a case for trial.
  • Excellent legal research and writing skills and have a demonstrated ability to prepare pleadings and legal briefs and memoranda for trials and appeals.
  • Thoroughly familiar with the attorney- client, deliberative process, and attorney work-product privileges.
